DMCA Policy
Breezy Johnson Engaged ("we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the Breezy Johnson Engaged website or other online services (the "Site") if such claims are reported to our Designated Copyright Agent identified below.
Filing a DMCA Notice of Infringement
If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent. Upon receipt of the Notice as described below, Breezy Johnson Engaged will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Site.
- Identification of the copyrighted work claimed to have been infringed: Provide a detailed description of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing: Provide a detailed description of the material that you claim is infringing, along with information sufficient to permit us to locate the material on the Site (e.g., URL(s) where the material is located).
- Contact information of the complaining party: Provide your full legal name, mailing address, telephone number, and email address.
- A statement of good faith belief: Include a statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information is accurate: Include a statement, made under penalty of perjury, that the information in the notification is accurate, and that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Electronic or physical signature: Provide your electronic or physical signature (typing your full legal name is sufficient for an electronic signature).
DMCA Counter-Notification
If you believe that your content was removed or disabled by mistake or misidentification, you may send a counter-notification to our Designated Copyright Agent that includes the following:
- Identification of the material removed: Identify the material that Breezy Johnson Engaged has removed or to which access has been disabled and the location (URL) at which the material appeared before it was removed or access to it was disabled.
- A statement of good faith belief: Include a statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your contact information: Provide your full legal name, mailing address, telephone number, and email address.
- Consent to jurisdiction: Include a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Breezy Johnson Engaged may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Electronic or physical signature: Provide your electronic or physical signature (typing your full legal name is sufficient for an electronic signature).
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability.
